1. GENERAL CONDITIONS OF SALE

These general conditions of sale (“General Conditions”) govern the purchase of products and services, carried out remotely, via the internet, from the site www.salumidiolompia.it (hereinafter referred to as “Site”) in compliance with Italian law pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter referred to as the “Consumer Code”).

The seller of the products and owner of the Site is: SEMERARO NICOLA with registered office in S.P. 216 CONTRADA LAMIE DI OLIMPIA, 217 – 70010 LOCOROTONDO (BA); VAT number IT05118380723 and registration in the Business Register of Bari n. SMRNCL65P15EG45E; e-mail: info@salumidiolimpia.it (hereinafter referred to as “Salumi di Olimpia”).
The user who accesses the site to make purchases (hereinafter referred to as “customer”) is required, before sending the order, to carefully read these General Conditions that have been made available to him on the site and which will be available in every moment.
In the event that the person making purchases on the site requests an invoice or is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the withdrawal discipline referred to in art. 7 and 8 of these General Conditions nor the provisions that, pursuant to the same Consumer Code, apply to “consumers”.

Contracts concluded through the salumidiolimpia.it site are governed by these General Conditions in compliance with Italian law.
The languages ​​available to conclude the contract are Italian or English.
These General Conditions may undergo changes and additions, without prior notification, at any time, to adapt to new requirements and / or legal obligations.
We invite customers to view it every time you consult the site.
Any use of the site (accessing, browsing, sending a purchase order, etc …), implies the reading and acceptance of these General Conditions.

2. ORDERS

The characteristics and the price of the products for sale on the site (hereinafter “product” or “products”) are shown on the page relating to each product.
To purchase products, the customer must follow the instructions on the site, fill out the order form in electronic format and send it. The choice of the product is made by adding it to the “Cart” and, after having read and accepted the General Conditions and the Privacy Policy, must enter the shipping and billing information, select the desired payment method and confirm the order.
Sending the order from the Site has the value of a contractual proposal and with it the customer acknowledges and declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these General and Payment Conditions.
The contract stipulated between Salumi di Olimpia and the customer is concluded with the acceptance of the order by Salumi di Olimpia. This acceptance is communicated to the customer through an order confirmation email containing all the reference data.
Upon receipt of the order Salumi di Olimpia reserves the right to check the availability of the products ordered, and in case of non-availability of some of the products, it will in any case proceed with the order for the products available, obviously charging only the cost of the products actually shipped and refunding any pre-authorized and unused amounts on the payment method chosen by the customer.

3. PRODUCTS

The cards on the site are as descriptive as possible of the product. The characteristics of the product are specified in the card itself. The photographic and / or visual representation of the product on the site, where available, has the sole purpose of presenting it for sale and may not be perfectly representative of the characteristics and quality of the real product. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

4. PRICES

The prices of the products are expressed in Euro and include taxes and duties.

SHIPMENTS IN ITALY:
Throughout Italy shipping is free for orders over € 150.00 or 5 kg, for smaller quantities the cost of shipping is € 10.00.

5. PAYMENT AND BILLING

5.1 Payment methods
The customer can pay by credit card or prepaid cards (PayPal virtual pos), PayPal account, bank transfer.

Credit card
To ensure maximum security, the salumidiolimpia.it site does not store the customer’s credit card number, as the customer will be redirected with a secure connection to the secure and efficient PayPal virtual POS upon order confirmation.

PayPal account
Upon confirmation of the order, the customer will be redirected to the PayPal site where he can make the payment with his account or using acard, also prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relative conditions.

Bank transfer
The customer must make the transfer within 3 working days from the order date; in the event that payment does not occur within 3 days, Salumi di Olimpia reserves the right to cancel the order and make the products available to all users of the site. The customer could be contacted by our Customer Service to clarify the cause of the non-completion of the payment.

Reason: indicate the date and order number in the reason for the transfer, which can be found in the confirmation email (eg “Order no. 34587377 dated 03-09-2020”).

5.2 Invoicing of orders
If the purchase is made by a professional or company, it will be possible to request the issuance of the invoice by selecting the appropriate box during the order procedure and entering the billing information including tax code and VAT number, PEC or UNIQUE CODE. In this case, a copy of the invoice (hard copy) will be sent by email to the address indicated and the electronic invoice will be sent to the SDI. The professional is responsible for the correct insertion of billing data and is expressly informed that, in case of failure to request the invoice during the order, it will not be possible to request it later.

6. TRANSPORT AND DELIVERY

The Products ordered on the site will be delivered to the customer from Monday to Friday, excluding holidays and national holidays, at the address indicated during the purchase procedure, or during registration.
Transport and delivery will be made by express courier; Salumi di Olimpia is not responsible for unforeseeable delays or those not attributable to it. Except in cases of force majeure, the ordered products will be delivered in Italy within a maximum of 30 (thirty) days from the day following the day in which Salumi di Olimpia confirmed the order to the customer by email. Shipments abroad can be made with different couriers depending on the country of destination in order to ensure the customer the best available rate.

7. RIGHT OF WITHDRAWAL

The Customer has the right to exercise the right of withdrawal by sending, within 14 days of receipt of the products, a written communication to the address: Salumi di Olimpia di Nicola Semeraro, S.P. 216 CONTRADA LAMIE DI OLIMPIA, 217 – 70010 LOCOROTONDO (BA), pursuant to art. 59 of Legislative Decree 21/2014 of 21 February 2014.
The communication can be sent, again within 14 days, also by email, provided that within the following 48 hours it is confirmed by registered letter with acknowledgment of receipt.
Upon receipt of the communication, the Customer Service will open a file for the management of the return and communicate to the customer the instructions on how to return the products that must be returned in good condition and carefully packed in the original packaging.
The right of withdrawal can be exercised only by natural persons who act for purposes not directly related to a professional activity (therefore purchases made by retailers and companies or subjects requesting invoices are excluded from the law).
The right of withdrawal is also excluded in cases of ordering products made to measure or personalized; order of products that are likely to deteriorate or expire rapidly; order of sealed products which cannot be returned for reasons of hygiene or health protection, which have been opened after delivery and which cannot be resold for reasons of hygiene or consumer health protection.

10. ERRORS AND LIMITATIONS OF LIABILITY

The information relating to the products provided through the site is constantly updated and as accurate as possible. However, guaranteeing the complete absence of errors is impossible and Salumi di Olimpia cannot be held responsible for any errors or omissions, except in the case of willful misconduct or gross negligence.
Salumi di Olimpia reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice, without prejudice to respect for the rights of the customer.
Except for willful misconduct or gross negligence, any right of the customer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial. , of an order.
